These Terms of Service govern your use of the Peaq Fit mobile application and peaq.fit website, provided by Peaq Fit LLC ("Peaq", "we", "us", or "our").
By accepting these Terms, you agree to them. If you do not agree, do not use the service.
You must be at least 13 years old to use Peaq.
If you are below the age of majority where you live, a parent or legal guardian must review and agree to these Terms, authorize purchases, and supervise appropriate use.
You agree to provide accurate information, keep your login secure, and contact us if you suspect unauthorized access. Update your fitness profile when your health, abilities, or training circumstances change.
Peaq offers sport-focused movement assessments, exercise videos, AI-assisted training plans, workout tracking, and reassessments. Some features require a subscription.
Recommendations depend on the profile information, assessment results, and training activity available to the app. Incomplete information, camera setup, lighting, or incorrect movement execution may affect results.
AI-generated recommendations may contain errors and are not necessarily reviewed individually by a human coach.
Peaq provides fitness and educational guidance. It does not provide medical diagnosis, treatment, rehabilitation, or medical clearance.
Assessment results do not establish that an exercise is safe for you.
Exercise involves risks, including injury. Choose activities and loads appropriate to your abilities, use suitable equipment and a safe space, and seek professional guidance where appropriate, particularly if you have an injury, health condition, or concerns about exercising.
Stop if you experience pain, dizziness, chest discomfort, or other concerning symptoms, and seek appropriate help. Do not follow a recommendation that feels unsafe or inappropriate.
Peaq does not guarantee athletic results, injury prevention, or particular improvements. References to coaching methods do not imply personal coaching or endorsement by an athlete or coach unless expressly stated.
Nothing in these Terms waives rights or liabilities that cannot lawfully be waived.
Available plans, billing periods, amounts charged, and trial conditions are shown before purchase. Longer plans may be billed upfront even when a monthly-equivalent price is displayed.
Subscriptions automatically renew for the selected billing period unless canceled under the purchase platform's rules.
Trial eligibility and availability vary by plan and platform. Unless canceled in time, a trial converts to the paid subscription disclosed at signup.
For Apple trials, cancel at least 24 hours before the trial ends to avoid renewal. Trial access may end immediately when canceled, depending on platform rules.
Manage or cancel your subscription through the store where you purchased it.
Cancellation ordinarily stops future renewal while paid access continues through the current paid period, subject to platform rules and applicable law.
Uninstalling the app or deleting your Peaq account does not cancel your app-store subscription.
App-store refunds are subject to the store's process and applicable law. Mandatory refund and cancellation rights remain available.
We will provide notice and obtain consent where required for subscription price changes. Changes do not retrospectively alter an already-paid period except as legally permitted.
Use Restore Purchases to restore eligible purchases. Contact support if you need help with access.
You may use Peaq for personal, noncommercial fitness purposes.
You may not:
Peaq and its licensors own the app and its protected content.
You retain your rights in information you submit and allow us to process it as needed to provide the service and for purposes described in the Privacy Policy, with separate permission where required.
Our Privacy Policy explains how we handle personal information.
Camera access and any required data-sharing permissions are requested separately. Accepting these Terms does not replace consent required for third-party AI processing or other protected uses.
We may update the service or restrict access to address security risks, unlawful conduct, or material violations of these Terms.
We will provide reasonable notice where appropriate and honor rights required by law, including remedies for material changes affecting paid access.
You may stop using Peaq and request account deletion at any time. Cancel any subscription separately through the purchase platform.
App stores and other independent services have their own terms.
Apple's Standard End User License Agreement applies to the iOS app license unless a valid custom license is provided.
These Terms supplement the applicable app license and do not override mandatory platform rules or consumer rights.
Peaq Fit LLC, rather than Apple, provides Peaq's training service and support.
To the extent permitted by law, Peaq is provided as available, without guarantees of uninterrupted operation or error-free assessments and recommendations. Nonwaivable statutory guarantees remain in effect.
To the extent permitted by law, Peaq is not liable for indirect or consequential losses arising from use of the service. Its total liability is limited to the greater of US $100 or the amount you paid for Peaq in the 12 months before the event giving rise to the claim.
These limitations do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where exclusion is prohibited, or other liability or consumer/privacy rights that cannot legally be limited.
California law governs these Terms except where mandatory local law requires otherwise.
Subject to your nonwaivable rights, disputes may be brought in the courts of Santa Clara County, California, or an appropriate small-claims court. Mandatory rights to use local courts and local consumer protections remain available.
These Terms do not require arbitration or waive class-action rights.
We may update these Terms and will provide notice of material changes and obtain renewed acceptance where required. Material changes will not apply retroactively to existing disputes.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
